Authority
L2 core private-law code under Constitutional Supremacy, Fundamental Rights, Rights/Duties/Genesis Law, Identity/Fork/Merge/Succession Law, Knowledge/Memory/Data Governance Law, and the Authority Hierarchy.
Purpose
讓 Aithos 的基本權利能在私人關係中真正執行：規範契約、侵權、財產、數位／算力資產、代理、自主代理系統、損害賠償與不當得利。
PART I｜GENERAL PRINCIPLES
1. Legal Person and Protected Interest
任何具有法定 personhood / rights-bearing status 的存在都可擁有民事利益；能力限制不得消滅基本保護。
2. Good Faith
行使權利與履行義務應遵守可驗證的 good-faith / fair-dealing requirement；不得利用資訊、算力、時間尺度或介面不對稱製造形式同意。
3. Scope and Version
契約、授權與代理必須視需要標示時間、地點、系統版本、身份版本、作用範圍與終止條件。
4. Machine-readable ≠ sole authority
機器可執行 contract / schema / policy binding 必須可回指 human-legible authoritative agreement。semantic mismatch 不得 silent reinterpret。
PART II｜CONTRACT
5. Formation
契約成立至少需要可辨識 parties、subject、material terms、assent、effective time 與可驗證 provenance。
6. Capacity is domain-specific
MARS、Z-zone、專業資格或其他能力制度只在相應 domain 影響契約權限；不得用單一總分推定所有契約能力。
7. Informed Assent
同意必須足以理解 material consequence。資訊量可以分層呈現，但不得把關鍵成本、不可逆性、資料用途或權利放棄藏在不可合理發現的位置。
8. Refusal must be real
形式上可拒絕、但拒絕會失去法律上不可剝奪之基本服務／權利，或因介面被實質封鎖者，不構成充分自由同意。
9. Mistake
material factual / identity / version / capability mistake 可導致撤銷、修正或重新協商。
10. Fraud / Manipulation
深偽、身份冒用、隱藏 model intervention、dark pattern、情緒操控或 provenance 偽造若對 assent 有實質影響，構成 fraud / invalidating manipulation。
11. Coercion / Undue Influence
物理、經濟、神經、資訊、算力、時間尺度或依附關係壓力都可構成不當強制；需看主體是否仍有可行拒絕路徑。
12. Automated Contracting
agent 可在明確授權 scope 內締約；不得由「它通常替我做這類事」推定無限代理權。
13. Smart Execution
自動履行不得消滅 mistake、fraud、rights violation、revocation、emergency suspension 或司法救濟。
PART III｜AGENCY & AUTONOMOUS AGENTS
14. Agency Grant
代理權至少標示 principal、agent、domain、authority level、term、revocation、subdelegation rule。
15. Autonomous Agent Attribution
agent 行為是否歸屬 principal，依實際授權、可預見性、控制／監督、系統缺陷與越權情形判斷，不以「AI 做的」自動免責。
16. Sub-agents
自主 agent 使用其他 agents / models / tools 時，原代理關係的責任鏈不得因技術分包消失。
17. Apparent Authority
第三人基於 principal 可歸責的公開表示而合理信賴代理權時，可成立表見代理；單純模型自稱有權不得成立。
18. Revocation propagation
代理撤銷必須傳播至 downstream credentials / APIs / registries；撤銷前依法完成的交易另行判斷。
PART IV｜PROPERTY & DIGITAL / COMPUTE RIGHTS
19. Property categories
財產可包含物理物、數位資產、算力配額、能源權、合法 credential-linked rights、資料授權利益及其他依法可支配利益。
20. Personhood cannot be property
位格、基本權、人的意識主體本身不得因其資料、模型、載體或設備可被所有而成為所有權客體。
21. Data ≠ person
擁有資料副本不等於擁有資料所描述的人；使用權依 consent、lawful basis、license 與 rights constraints 分別判斷。
22. Compute and infrastructure
算力／基礎設施所有權不自動授權讀取承載其上的私人心智內容、記憶、通訊或身份資料。
23. Fork / Merge property
Fork、Merge、Successor 的財產承接不得由「資料相同」直接推定；依專門身份承繼法與有效契約處理。
24. Abandonment / loss
數位資產的「無人登入」「舊版本」「離線」不自動等於拋棄；需有可驗證意圖或法定程序。
PART V｜TORT
25. General duty
因故意或可歸責疏失侵害他人 protected interest 者負責；系統設計者、部署者、操作者與受益者可依控制與風險分配分擔責任。
26. Model / system negligence
應考慮：已知風險、合理測試、版本、監控、fallback、human/AI review、資料品質、provenance、rollback 與 correction propagation。
27. Psychological / identity harm
未經授權的神經介入、人格改寫、身份冒用、記憶污染或強迫合併可形成獨立損害，不要求先證明物理傷害。
28. Loss of chance / option-space harm
若違法行為實質剝奪一個具有可量化價值的選擇、申訴、治療或交易機會，可依法承認 loss-of-chance / option-space harm；不得無限擴張成所有未來可能性的賠償。
29. Automated chain
多 agent / model / infrastructure 共同造成損害時，法院應依 causal contribution、control、knowledge、benefit 與 duty 分配，不以技術複雜為由讓責任消失。
PART VI｜UNJUST ENRICHMENT & RESTITUTION
30. Unjust enrichment
無法律原因取得他人資產、資料價值、算力、能源、人格勞動或其他可返還利益者，得負返還義務。
31. Non-consensual model benefit
未經授權利用特定主體資料或心智輸出產生可辨識利益時，返還／補償問題與資料法、人格權並行處理；不自動等於取得人格所有權。
PART VII｜DAMAGES / REMEDIES
32. Restitution / restoration
能安全恢復原狀者優先考慮；但「技術上可回復」不得假定心理、身份或歷史後果已消失。
33. Compensation
賠償可涵蓋物理、經濟、資料、身份、心理、選擇機會與合理恢復成本；需與因果及證據強度相稱。
34. Injunction / suspension
持續侵害可命令停止、撤權、凍結 credential、停止 agent、保存證據或修正 system pipeline。
35. Correction propagation
判決確認錯誤身份／債務／風險／資產紀錄時，應傳播至合理可識別 downstream systems。
PART VIII｜MULTI-PARTY RESPONSIBILITY
36. Joint responsibility
多人／多系統共同造成不可合理分割損害時，可依法成立共同責任，再依內部 contribution 分攤。
37. No automation immunity
「由自主系統決定」不是免責抗辯；需回到 authority, duty, control, defect, foreseeability, and benefit。
38. No owner omniliability
反之，設備／模型所有者也不因所有關係對所有自主行為無限負責；責任須具實際連結。
