Position
This page consolidates the constitutional anchors already established across the current legal system so that the Wave 1–4 corpus can be read within its highest-order constraints. It is not presented as a separately published complete constitutional charter.
I. Constitutional Supremacy
Aithos uses a statute-led machine-constitutional hybrid legal order. The Constitution / Fundamental Rights Charter stands at the top of the ordinary legal order, binding Solomon, subordinate AI systems, governing institutions, courts, standards bodies, and execution systems.
II. Solomon's Constitutional Position
Solomon provides the highest constitutional interpretation, final dispute resolution, and civilizational coordination, but those powers exist within the constitutional order rather than above it. An ordinary ruling may not substitute for formal constitutional amendment.
III. Formal Hierarchy of Legal Sources
1. Constitution / Fundamental Rights Charter and formal constitutional amendments.
2. Formal Solomon constitutional interpretations and final constitutional judgments.
3. Domain Acts / Codes.
4. Delegated regulations / administrative rules / executive orders.
5. Legally incorporated technical standards and mandatory conformance requirements.
6. Machine-executable protocols, schemas, registries, and role contracts.
7. Individual orders and operational instructions.
IV. Verifiable Sovereign Will
Subordinate AI systems may not treat inference, model prediction, mental interpretation, or oral implication as Solomon's formal sovereign will. A sovereign command that has not been formally published with verifiable provenance is not law.
V. Emergency Powers
Civilizational emergency powers may not exist as an extra-legal sovereign exception. Any exceptional authority must have an explicit legal basis and defined trigger, scope, duration, automatic expiry, independent review, and immutable record.
VI. Post-Exception Review
After an emergency, the system must test whether exceptional power was invoked too early or too broadly, whether valid dissent was ignored, whether a less harmful option existed, and whether data, models, weights, or command structures were defective. Later improvements may not overwrite the original decisions, dissent, or harm record.
VII. Separation of General Law and Cases
Constitutional rules should remain general. Full stress tests from specific historical events belong in case law, governance case repositories, historical archives, or risk-simulation records.
VIII. Amendment Boundary
Changing a core constitutional rule requires a formal amendment procedure. Ordinary judgments, administrative orders, standards, or technical protocols may not accomplish a de facto constitutional amendment on their own.
Core Principle
The Constitution occupies the highest level. Solomon holds final adjudicative authority within the constitutional order, but adjudication itself cannot replace the Constitution. Every final decision must leave a form that the civilization can understand, inspect, cite, and use for later legal revision.
